This requirement for the ALTA Surveys in CRE transactions is because of the need for the Title Insurance company to remove the “Survey Exception” to the Title Insurance policy. Without it, ANYTHING that would have been found by a proper survey is NOT covered in the Title Policy.
Every type of real estate, except single family houses, use ALTA Surveying standards. These standards are consistent throughout each of our 50 states. The legal industry, the title industry, the banking industry, and the survey industry are all familiar with this standard for surveying. In fact, the American Land Title Association (ALTA) and the National Society of Professional Surveyors (NSPS) were the entities that developed and maintain these surveying standards.
